Michael Oyler's Will

In the name of God Amen, I Michael Oiler of Franklin County in the State of Pennsylvania of Sound and disposing mind memory and understanding, do publish and declare this instrument as and for my last will and testament. I give and devise with My beloved wife Barbara Oiler (in lieu of dower or quitha [?] on my estate) the One third of the rents or net process of My two farms, during her life, the one lying and being in Washington County Maryland, the other in Franklin County, Pennsylvania with the privilege of Occupying the dwelling House and garden on my farm in Washington County Maryland and Such Stable room as she may require for one horse & two cows, with pasturage on said farm. I further give and bequeath unto my wife the choice of One of my houses, two cows all my poultry, such, and so many sheep and hogs as she may wish from my stable, all my household and kitchen furniture and all provision laid up at the time of my decease. I further give and bequeath to my said wife, the sum of five hundred dollars (500) all the personally here devised to my wife to be had absolutely. I Order and direct that all the residue of my personal estate shall be divided into two parts, of which my son David Oiler Shall receive the One part, the other part to be taken and held by him as hereinafter directed. I give and devise to my son David Oiler his hens and assigns [sic] forever, my farm in Franklin County Pennsylvania Containing about two hundred and twenty acres of land Subject to the devise made to my wife as aforesaid. I further give and devise to my son David Oiler his hens and assigns [sic] my farm in Washington County Maryland Containing about two hundred and thirty three acres of land (subject to the devise to my wife as aforesaid) as also the One half of my personal estate as aforesaid; to have and to hold the same upon the trust and for the use and purposes herein, [illegible] and trust to apply the annual rent and profits of said farm and the interest on said personal property for the sole & separate use of my daughter Ann Maria who married a certain Joseph H. Besore [?], for with during her life free from the control of her husband and from and after decease [illegible part] of the said farm and said personally for the use of such child or children my daughter may bear, in [illegible] there up to my right kind forever I [illegible part] appoint my son David Oiler Executor of this my will, making and [illegible] all former wills . In Testimony whereof I have hereto subscribed my name & affixed my seal this [illegible] day of April 1846.

Signed, sealed, published and declared by Michael Oiler the above named testator on and for his last will and testament, in our persons, who at his request, in his presence, who at his request, in his person, [sic] and in the foresaid of each other, have signed our names as witnesses thereto

Before me George W. Toms Register of the probate of wills to in and for said County personally came Isaac. H. Durbaraw [sic] and Henry Jacobs [illegible] of the subscribing witnesses to the foregoing instrument of writing who being duly sworn according to law aid depose and say that they were personally present and saw Michael Oyler [sic] now deceased write his name unto and heard him publish pronounce and declare the same as and for his last will and testament, and that at the time of the doing thereof he was of Sound and disposing mind memory and understanding according to the best of their knowledge and belief, and also that they saw John Jacobs who is now deceased who was subscribing witness to said will unto his name thereto as witness in the presence of said deponent [??] and of said testator, and that they know his signature thereto to be in his own proper hand writing, and that they the said deponents know the said John Jacobs is now decd. & said deponents further say that their names thereunto subscribed are in their own proper hand writing and done at the same time & in the presence and at the request of the said testator and in the presence of each other.

May 16th 1859. You David Oiler do swear that as Executor of the last will and testament of Michael Oiler You will will and truly administer the goods & chattels, rights and credits of said deceased according to law & also diligently and faithfully regard and will and truly comply with the provisions of the law relating to Collateral inheritances.
