Southern Claims Commission: Claim of John D. Price, September 13, 1871, Claim No. 6901

Summary: John D. Price's claim for two horses was rejected because the Commissioners were not convinced of his loyalty. Details of his claim correspond with those of his father, John Price. His claim was forwarded to the Congressional Court of Claims with that of his father, although only the senior Price seems to have been involved in the appeal.

Claims Summary:

Claim rejected.

Mr. John D. Price says he did not vote on the ratifying of the Ordinance of Secession. But his name is on the poll list of Augusta Co. as voting for ratification

He says he was arrested & put in the rebel Army & in 2 or 3 weeks he deserted.

But he had a brother in the Union Army & another who was trying to get there & was taken by the rebels-and died.

The name of his witness Sansabaugh is on the poll list as voting for secession.

We are obliged to reject the claim.

Testimony: John D. Price

Deposition of Jno. D. Price Claimant.

Ques 1 Witness Says: I am 31 years old. I reside in Augusta co. Va. I am farmer. Have lived in Augusta Co 31 years. I lived in Augusta Co six months prior to April 1 1861

3 Witness Says I never passed the military or Naval lines of the U.S. & entered the rebel lines.

4 Witness say, I never took the oath of Allegiance to the Confederate States.

5 Witness says, I took the amnesty oath in 1865, in Staunton Va. Have never been pardoned.

6 Witness says: I never was in any manner connected with the civil service of the Confed. States.

7 Witness Says, I never held any office or place of honor profit or trust under the Confederate States.

8 Witness says: I never held any clerkship or agency of any kind, under the Confederate States

9 Witness says: I was conscripted into the Confederate army, but I deserted in a short time, & staid in the mountains.

10 Witness says: I was in the confederate army a short time, two or three weeks. Did not furnish any subsitute, was not connected with any other Dept of the Confed Govt. Did not have charge of any store, supplies trains, teams or wagons, for the Confed Govt.

11 Witness says, Was in no service, business or employment of any kind, except as stated above.

12 Witness Says: I never was engaged in the manufacture of any goods of any kind for the rebel Govt.

13 Witness Says: I never was engaged or interested in the purchase or collection of stores or supplies of any kind for the Confed. Govt.

14 Witness says, I never was engaged in blockade running.

15 Witness Says, I did not leave the Confederacy between the 19 of April 1861 & April 19th 1871

16 Witness says Never was engaged nor interested in any vessel navigating the Ocean to or from any port of the Confederacy

17 Witness says, I was arrested by the Confederate Govt. in 1863, in Augusta Co. by a confederate conscript officer. I took no oath to the Confederate Govt. to obtain my release. Was never arrested by the U.S. Govt.

18 Witness says, None of my property was ever taken by the Confederate Authorities

19 Witness says: I was threatened with injury if I did not aid the confederacy. It was when I was conscripted.

21 Witness says: I never contributed anything to the U.S. Govt. its Army or Navy.

23 Witness says I had a brother in the US army. Killed at Shiloh I had another brother, arrested while going to the Union Army taken to Staunton imprisoned & died.

24 Witness says: Did nothing to supply them with money or equipments Have never owned any Confederate bonds, nor done anything to support its credit

25 Witness Says: I have never given aid or comfort to the rebellion

26 Witness says, I never engaged in making raids from Canada into the U States or in destroying its Commerce.

27 Witness says: I was never engaged in holding in custody any persons taken by the Confederate Govt. as prisoners of War.

28 Witness says, I never was a member of any society for the imprisonment or persecution of any one on account of loyalty to the U. States

29 Witness says, I never was a paroled prisoner of the U. States

30 Witness Says, I never held any office in either the Army or Navy of the U.S. was not educated at either West Point or the Naval Academy.

31 Witness says, I never rec'd any pass from any officer of the Confederate Govt.

32 Witness says, I never was, & am not under any disabilities imposed by the 14th amendment of the Constitution of the U.S. Have held no office under the U.S. Govt since the War.

33 Witness says: At the beginning of the War I sympathized with the Union caus. I voted neither for no against the ordinance of secession. After the adoption of the ordinance of secession I adhered to the Union Cause, & did not go with my state.

34 Witness says, I do solemnly declare, that from the beginning to the end of the war I sympathized with the Union Cause, & I was ready & willing at all times to aid them as far as I was able, & my circumstances permitted & further this deponent sayeth not.

Testimony: John Price

Deposition of Jno. Price to prove taking of property

Ques 1 Witness Says, I am 49 years old. I reside in Augusta Co Va. I am a wagon maker. I was not present when the property was taken, did not see them taken. But saw them in possession of officers & soldiers of the U States Army.

4 Witness says: I saw them in possession of soldiers, about the 10th of June 1864, it was taken from the claimants farm, by officers & soldiers of the US Army.

6 Witness says: I saw officers & soldiers with them, did not know his rank or regt. but he belonged to Averillscom'd.

8 Witness says, Was carried off by Soldiers, rode off.

9 Witness says: Was taken to the army, toward Lexington Va.

10 Witness says: It was taken for the use of the U.S. Army

11 Witness says: The claimant complained to the Officer, the Officer told them he would some day be paid for them

12 Witness says No receipt was asked for & none given

13 Witness says, It was taken about 11 o'clock in the day, none taken secretly.

14 Witness Says, When the property was taken the Army was marching by there had been no battle or skirmish nearby the men who took the property. Did not know any of the Qr.Mr.

15 Witness says, They were two fine horses. One fine grey horse, 7 years old, worth One hundred & fifty dollars. One brown mare 4 years old, worth $150.

19 Witness says, I think the horses were taken for the use of the US Army & for no other use

22 Witness says: I believe it was taken for the necessary use of the army, & that the Govt. should pay for them

23 Witness says: I think those who took the property had authority to take it or order it taken, & further this deponent sayeth not

Testimony: David Sansabaugh

Deposition of David Sansebaugh to prove loyalty

Ques 1 Witness Says: I am 45 years old. I reside in Augusta Co Va. I am a farmer. Have known the claimant all his life, live near him. Saw him often during the War. Was with him in the brush, talked with him frequently. He was loyal to the U.S. Govt. he was so regarded by his neighbors. Did not do any thing for the U.S. Govt. or the Confederate Govt. during the War. He fed men escaping from the Confederacy. He was too loyal to the U.S. Govt. to have been loyal to the Confederacy, had it succeeded, & further this deponent sayeth not.
